Mumbai: Aryan Khan and two others – Arbaz Merchant and Munmum Dhamech – were given bail on Thursday by the Bombay High Court in the cruise drug case.

Justice Senior Counsel Mukul Rohatgi defended Aryan, and the Singh ASG Anil for the Narcotics Control Bureau were given a bail by Judge Nitin W Sambre for the 3 Senior Advocates (NCB).

Live law has stated that on Friday detailed orders with reasons will probably be published.

Rohatgi contended that the arrest of Aryan had been done in blatant violation of Article 22, and that the reason for Aryan's detention had not been communicated.

"Aryan knew no one on the ship besides Arbaaz and Achit, who after 4 days was imprisoned. He had 2.4 gms, which he stated was a dealer (of drug). A dealer must have two hundred gms," he told the court.

ASG Anil Singh objected to the bail since the memo on trade in narcotics quantities was highlighted. He said that the star youngster tried to deal with commercial quantities of narcotics and that the NCB never concerned "consumption." "Having Arbaaz in possession, Aryan Khan was aware. Charas was for smoking and for drinking, yet it was physically with Arbaaz," he claimed.

Section 29 of the NDPS Act regarding conspiracy was also underlined. "The individual has not to be in possession, Section 29 does not indicate. He tried to cope with business quantities," remarked ASG.

Aryan has been in judicial detention since October 8, captured on 3 October during a late-night raid on a cruise liner. The magistrate and the Special NDPS courts had already denied his bail petition three times.
