HC asks police to file 'misbehaviour' case against Anandpur MLA

Keonjhar: Bhagirathi Shetty, a BJD MLA from Anandapur, has been arrested for allegedly misbehaving and threatening BJP Zilla Parishad member (zone 3) Asima Mishra about five months ago.

On Sunday, the Koenjhar police registered a case against the legislator under Sections 294 (sings, recites, or utters any obscene song, ballad, or words in or near any public place) and 506 (criminal intimidation) of the Indian Penal Code (IPC).

The incident occurred on August 30, last year, during a meeting of the Anandapur panchayat samiti. Asima claimed that the MLA was rude to her when she inquired about the status of some development projects and asked her to leave the meeting. She had also filed a complaint with the Anandapur police station, but they refused to open an investigation. She had even approached the Keonjhar SP about the matter. "I petitioned the court after police failed to provide justice to a people's representative. "I hope the police will now conduct a proper investigation and take appropriate action," she said.

According to Anandapur police station IIC Debaki Nayak, action will be taken after a thorough investigation.

Sethy, on the other hand, has flatly denied the charge.

On Friday, a case was filed against another BJD MLA, Bijaya Shankar Das, under Sections 376 (punishment for rape), 313 (causing miscarriage without the consent of the woman), 506 (punishment for criminal intimidation), and 34 (common intention) of the Indian Penal Code, after the High Court ordered police to investigate a new complaint filed by his alleged girlfriend, Somalika Das.

On June 18, last year, she filed a police report against him, alleging sexual harassment, betrayal, and cheating. The lawmaker was then charged under Sections 154 (1) of the CrPC, 420, 185 A, 506 B, 294, 509, 341, 120 B and 34 of the IPC, and 3, 4, 5, 6 of the Immoral Traffic (Prevention) Act, 1956. She did, however, file a complaint with the High Court because the police did not charge the MLA under Section 376 of the IPC and did not arrest him.

On Sunday, Union Minister Dharmendra Pradhan cited this case, along with others in which the Supreme Court had to intervene, as evidence that the law enforcement agency was not doing its job.
