New Delhi: Orissa and Central governments have been given 8 weeks to file a response in response to Supreme Court's notice on elimination of the Odisha Administrative Tribunal.
Three-judge bench of the Supreme Court comprising Justices L Nageswara Rao, Sanjiv Khanna, B R Gavai heard an appeal filed by Orissa Administrative Tribunal Bar Association against Orissa high court order upholding notification issued by the Department of Personnel and Training on August 2, 2019 which abolished the Tribunal.
Applicant claims centre gave notice based on section of 1897 General Clauses Act (GCA) (GCA). This power is implicitly prohibited under the Administrative Tribunals Act of 1985, according to the report.
As a result, when the state government argued that the Tribunal did not fulfil the objective of providing fast justice to plaintiffs, the high court agreed with the government because it found sufficient evidence to support its position.
He filed a petition with the Supreme Court, asking it to overturn the judgement of the state's top court, which supported the state's unlawful and arbitrary decision.
In addition to the Ministry of Personnel, Public Grievances and Pension, the state of Odisha has been served with the notice.
